This document combines the Terms of Service and Privacy Policy into a single legal document.

1. About the Project

GigaDel is a private, non-commercial personal catalog created for the convenient search of services and orders. The project is managed by an individual and is not a commercial platform, intermediary, or service provider.

GigaDel acts as an aggregator (catalog) of publicly available information, serving as an intermediary service in accordance with Regulation (EU) 2022/2065 on Digital Services (Digital Services Act — DSA), Article 3(g).

The data controller within the meaning of Article 4(7) GDPR is the owner and operator of the project. The project is not large-scale and processes the minimum necessary amount of data to perform its function.

2. Sources of Information

GigaDel performs the function of search indexing (cataloging) of publicly available information — similar to how search engines (Google, Yandex) index content on the internet. The project collects only data that is already publicly available.

Information in the catalog is collected from publicly available sources:

  • Public social media profiles — data that users voluntarily publish in open profiles (Telegram, Instagram, WhatsApp, etc.);
  • Open internet sources — information legally published in public places;
  • Voluntary addition of information — data that users independently upload through project forms.

3. What Data We Collect

The project may collect and process the following categories of data:

3.1. Data from Publicly Available Sources (Legitimate Interest — Art. 6(1)(f) GDPR)

  • First and last name (from public social media profiles);
  • Contact information (Telegram username, WhatsApp number, Instagram username) — only if it is publicly available or voluntarily provided;
  • Description of services and orders;
  • Photos and images;
  • Geolocation data (city, address, service area);
  • Prices and terms of service provision.

3.2. Data Provided Voluntarily (Consent — Art. 6(1)(a) GDPR)

  • Email address (upon registration);
  • Username and password;
  • Additional information filled in the user profile;
  • Data provided through feedback forms.

3.3. Technical Data and Cookies (ePrivacy Directive)

  • IP address (in anonymized form for analytics);
  • Browser and device type;
  • Technical cookies — necessary for the website to function;
  • Analytical cookies — Google Analytics (see section 12);
  • Advertising cookies — Google Ads and other advertising networks (see section 12).

4. Nature of Information

Information in the catalog is provided "as is" for informational purposes only. The project does not guarantee the accuracy, completeness, or timeliness of the data, as it is collected from third-party sources. The project is not obliged to verify the accuracy of information posted by users, in accordance with DSA, Article 6 — a good faith, reasonable, and proportionate approach to content moderation.

The catalog does not collect data in ways that violate users' reasonable expectations of privacy. If you believe that your data has been included in the catalog without sufficient grounds, you can immediately request its removal via the "Report" button.

5. Legal Bases for Processing

Personal data is processed on the following grounds:

6. Purposes of Processing

Data is processed for the following purposes:

  • Formation and maintenance of a catalog of services and orders;
  • Ensuring communication between customers and performers;
  • Collection of analytics and website usage statistics (Google Analytics + internal analytics);
  • Displaying advertisements — processing data for targeted advertising (Google Ads and other advertising networks);
  • Improving functionality and user experience;
  • Processing user complaints and requests;
  • Compliance with legal obligations (legal compliance).

7. Complaint & Removal Mechanism

If you find inaccurate, unreliable, or outdated information about yourself or your activities, you can use the "Report" button on the page of each service or order.

Complaint review procedure:

  1. The user clicks the "Report" button and describes the reason;
  2. The complaint is submitted for consideration by the project administrator;
  3. Within a reasonable time, the administrator decides: to delete, edit, or leave the information unchanged;
  4. The user is notified of the review result.

This mechanism implements:

  • Right to rectification Article 16 GDPR (Right to rectification);
  • Right to erasure ("right to be forgotten") Article 17 GDPR (Right to erasure);
  • Notice and action mechanism DSA, Article 16 (Notice and action mechanism);
  • Internal complaint-handling system DSA, Article 20 (Internal complaint-handling system).

8. Your Rights under GDPR

In accordance with General Data Protection Regulation (EU) 2016/679, you have the following rights:

  • Right of access Art. 15 GDPR: to request information about what data is being processed;
  • Right to rectification Art. 16 GDPR: to demand correction of inaccurate data;
  • Right to erasure Art. 17 GDPR: to demand deletion of data (right to be forgotten);
  • Right to restriction of processing Art. 18 GDPR: to demand restriction of processing;
  • Right to object Art. 21 GDPR: to object to processing based on legitimate interest;
  • Right to data portability Art. 20 GDPR: to request data in a machine-readable format;
  • Right to lodge a complaint Art. 77 GDPR: to lodge a complaint with a supervisory authority.

9. Data Subject Rights under Article 14 GDPR

If personal data is collected from publicly available sources, the project provides information to data subjects in accordance with Article 14 GDPR.

This includes:

  • Information about the data controller (project owner);
  • Categories of personal data collected;
  • Purposes of processing;
  • Legal basis for processing;
  • Recipients of personal data;
  • Retention period;
  • Rights of the data subject (access, rectification, erasure, etc.);
  • Right to lodge a complaint with a supervisory authority.

10. How to Exercise Your Rights

The fastest way to exercise your rights is to use the "Report" button on the page of a specific service or order. In the complaint description, specify what action you want: rectification, erasure, or restriction of processing.

Alternatively, you can use the "Feedback" button in the website footer to submit a request. The project undertakes to respond to the request within 30 days (Art. 12(3) GDPR).

11. Data Sharing with Third Parties

The project does not transfer personal data to third parties, except in cases where it is necessary to fulfill legal obligations or to provide the functionality of the service.

This may include:

  • Hosting providers — for storing data on servers;
  • Analytical services — Google Analytics (anonymized data);
  • Advertising partners — Google Ads (anonymized data for targeted advertising);
  • Law enforcement agencies — upon official request.

12. Data Retention

Personal data is stored for the period necessary to achieve the purposes for which it was collected, or until the data subject requests its erasure.

  • Data from publicly available sources — until a request for erasure or removal from the source;
  • Data provided voluntarily — until the user account is deleted or a request for erasure;
  • Technical data and analytics — up to 26 months (Google Analytics policy).

13. Cookies and ePrivacy Directive

The project uses the following types of cookies in accordance with Directive 2002/58/EC (ePrivacy):

  • Technical cookies — necessary for the website to function (sessions, authentication). Do not require consent (exception Art. 5(3) ePrivacy);
  • Analytical cookies — Google Analytics. May require prior consent in accordance with the practice of EDPB;
  • Advertising cookies — Google Ads, etc. Require prior consent in accordance with Art. 5(3) ePrivacy.

14. International Data Transfers

Personal data may be transferred to countries outside the European Economic Area (EEA), in particular to the USA, where some service providers (e.g., Google Analytics) are located.

Such transfers are carried out in compliance with GDPR requirements, including through the use of:

  • Standard Contractual Clauses (SCCs) — approved by the European Commission;
  • Data Privacy Framework (DPF) — for transfers to the USA, if the recipient is certified under DPF.

15. Compliance with Digital Services Act (DSA)

In accordance with Regulation (EU) 2022/2065 (DSA):

  • The project provides a mechanism for notifying about illegal content (Art. 16);
  • The project has an internal complaint-handling system (Art. 20);
  • The project publishes information on the average number of active users upon request (Art. 24(2));
  • The project does not apply algorithmic ranking based on user profiling.

Currently, the project is not obliged to appoint a representative in the EU in accordance with Article 27 GDPR, however, all requests are processed as a priority.

17. Governing Law

These terms are governed by the laws of the project owner's country of residence. Disputes are resolved through negotiations, and if unsuccessful, in court at the project owner's location.

We may change this document at any time. The current version is always available at this link. By continuing to use the project after changes, you accept the new terms.
